케어는 산하에 <동물법 센터-Animal Justice>를 조직하고 ‘동물보호법 전면개정 프로젝트’를 열었습니다.
11명의 연구자와 13명의 패널, 34명의 자문단(자문위원 포함), 3명의 기획팀으로 구성된 동물보호법 전면개정프로젝트는 현재 활발한 연구들이 진행되고 있습니다.

"동물학대 현장에서 격리조치를 요구할 때, 동물보호센터 공간 부족 때문에 이행이 안 되는 경우가 있습니다. 일리노이주의 경우 그러한 경우, 현장에서 동물을 보호할 수 있게 법에서 명시하고 있습니다.

격리조치를 한 후, 지자체에서 학대자에게 보호비용 청구를 미루어서 소유권 포기가 늦어지는 경우가 빈번합니다. 일리노이주의 경우, 격리조치를 할 때 앞으로 발생할 보호비용을 추산하여 보증금을 내도록 정하고 있습니다.

격리조치를 해도, 소유권 포기는 쉽지 않습니다. 일리노이주의 경우, 재판이 시작되기 전에 몰수가 가능하도록 법에서 정하고 있습니다.”

동물보호법 전면개정 프로젝트 3차 모임에서 나온 이야기입니다. 함태성 한국환경법학회장은 축사에서 이 프로젝트의 의의에 대해 다음과 같이 말했습니다.

"현행 동물 입법은 ‘거버넌스’ 역할 증대라는 측면에서 아쉬운 점이 있습니다. 입법의 준비과정이나 타당성 검토 과정에서 시민들의 참여와 역할이 부족합니다. 입법 과정에 적극적으로 참여하여 동물보호 관련 법령의 개선을 이루어 내기 위해서는 동물법적 관점에서 제시되는 전문적이고 실질적인 입법 제안들이 요구된다고 하겠습니다.

저는 케어의 ‘동물보호법 전면 개정 프로젝트’가 이러한 역할을 할 수 있을 것으로 생각합니다. 동물 관련 입법의 연구를 통하여 입법부와 우리 사회에 실질적인 대안들을 적극적으로 제시하고 나아가 동물 입법의 발전에 기여하리라 믿습니다."

동물보호법 전면개정 프로젝트는 시민입법운동의 한 사례입니다. 시민이 앞장서서 동물을 보호하고자 하는 시도입니다. 내 눈 앞의 동물만이 아니라 그보다 훨씬 더 많은, 동물 일반을 보호하고자 하는 시도입니다. 이 프로젝트에 참여와 후원으로 힘을 실어주십시오.

Care organized a law center, Animal Justice, and initiated a project to comprehensively revise the Animal Protection Act. Members of the law center, which is composed of eleven researchers, thirteen panels, thirty-four advisory committees, and three members of the planning team, are actively studying and discussing how to revise the Animal Protection Act.

“There are often cases where keeping abused animals out of the hands of abusers is difficult due to the lack of rooms in shelters. The animal protection law in Illinois ensures that animals can be protected on-site, banning pets from their owners. There are also cases of the delayed surrender of pet ownership due to delayed expense reimbursement claims of local government; In the case of Illinois, when the measure of isolation is taken, the estimated expenses of protection should be included in the reimbursement claims. Finally, making abusers surrender their pet ownership is one of the most difficult parts of rescuing the abused animals; but in Illinois, Authorities can impound the animals before a trial begins. “

The quote is from a presentation delivered during the 3rd seminar of the animal law revising project. When we initiated the project on December 3, Ham Tae-sung, the president of the Korean Society of Environmental Law, emphasized the significance of the project in a congratulatory address. 

“I find the current legislative process regarding animals insufficient, particularly in terms of its failure to increase governance. In other words, there is a lack of civic participation or civic engagement in preparing legislation or examining its feasibility. And in order to encourage more civic participation in the legislative process and improve animal protection laws, we also require professional and practical legislative proposals from the legal perspective.

I believe that the project of revising the Animal Protection Act, initiated by Care, can be instrumental in bridging the gap. I believe that this project will offer a viable alternative to the legislature and our society. I expect that it will contribute to the overall improvement of animal-related legislation.”
