와치독, 강화축산 도살자 법률로 압박해 무릎 꿇리다. > watchdog

-도살장의 개들 99명 전부 다, 강화군청 소속으로 인계 시키고 도살장은 영구히 폭파-

많은 분들이 관심과 항의 민원을 넣었는데도 도살자는 꿈쩍도 하지 않아 애 타 하신 강화축산 건이 이제 해결되었습니다.

도살장이 분명한데도 ‘도살자가 도살하지 않았다고 주장하니 격리조치를 할 수 없다’는 입장이 완강했던 강화군청을 와치독은 수차례 직접 면담하며 관련된 여러 법률들을 자세히 설명하고 이해시키며 도살자에게 벌금과 과징금, 과태료등을 총망라해 강하게 압박하라고 요구하였습니다.

도살자는 정부의 개식용 종식 위원회에서 검토된 ‘보상을 전제한 협상’ 과 관련, 정부에서 위임받은 조사관들이 개농장들을 직접 찾아다니자 보상이 기정사실화된 것으로 판단, 계속 버티기로 일관한 것입니다. 버티다 보면 큰 보상을 받을 것이라 생각하고 벌금이나 과징금 따위 는 신경도 쓰지 않았던 것입니다.

그러나 와치독이 각 부서 공무원들에게 미리 각 부서에서 부과할 수 있는 과태료를 정리하게 해 놓고 축산과장이 도살자를 만나 전체 위반 사항에 대한 과태료 금액을 설명하게 하였습니다. 이를 들은 도살자는 결국 모든 동물을 포기하였습니다. 불가능한 희망보다 오히려 본인이 당장 부과해야 할 과태료, 향후 고발당해 낼 수 있는 벌금의 규모가 하나의 위반마다 수백에서 수천만원까지 되는 등 훨씬 더 큰 금액이라는 것을 뼈저리게 알게 해 준 것입니다.

와치독이 만난 개도살자는 이미 수많은 민원에 단련돼 있었고 처벌을 피할 수 있는 방법도 학습되어 있는 용의주도한 인물이었습니다.
이런 도살자를 잡는 방법은 준비 없이 감정적으로 대응하기보다 치밀하게 계획하고 접근하여 한 번에 일망타진하는 것이 좋습니다.

많은 분들이 민원을 넣고 개들을 일부 구조해 나가고 있었지만 전체 다는 포기하지 않는 상황이 이어지고 있어 와치독이 개입하게 되었습니다.

와치독이 법으로 압박한 내용은 간단히 다음과 같습니다.

우선 와치독은

1.남은 음식물을 처리하여 수익을 발생하지 못하게 남은 음식물 반입을 차단시켰습니다.

2.불법건축물로 인해 벌금이 수천만원을 감당해야 한다는 것을 도살자에게 주지시켰습니다.

3.가분법 위반으로 과태료와 고발조치 당한 다는 것을 알려 주었습니다. (최초 신고당시 배출시설로 준공검사까지 하여 공무원들도 가분법 문제가 없는 줄 알았지만 와치독 현장 조사 결과 도살자 본인이 배출시설을 멸실했음)

와치독은 강화군청이 강화축산에서 인계받은 개들에 대해 최대한의 지원을 하도록 계속 힘쓸 것입니다. 또한 도살장을 영구히 폭파시킬 것입니다.

- 99 dogs of the slaughterhouse are now taken over by Ganghwa County Office

Many of you have filed numerous complaints about the slaughterhouse in Ganghwa, and yet it has resisted stubbornly without showing any will to change. The owner not only had vast experience in receiving complaints, but also had the know-how to minimize penalties. 

He was determined to disregard all penalties and administrative guidance, presumably because he seemed to be expecting “compensation during a negotiation” which was considered by the Committee of Abolishing Dog Meat that is established by the government. 

For the last several months, Watchdog has persistently persuaded the Ganghwa County Office, which at first was extremely reluctant to take any measures of banning pets from the owner simply because “the owner is denying the accusation.” We continued to compel them to take any actions that could force the owner to realize how substantial the monetary fines can be imposed on him. 

As a result, the manager of the livestock department of the Ganghwa County Office had a meeting with the owner of the slaughterhouse; The owner eventually surrendered the ownership after it was clarified in detail that the monetary penalties he will be receiving can reach from millions to tens of millions of won per violation. 

The followings are a summary of Watchdog’s activities.

1. Watchdog disposed of all food waste that is used as animal feed in order to damage their finance and create pressure on them.
2. Watchdog put pressure on the owner by reminding him of the fact that violation of the Building Act can reach up to tens of millions of won.
3. Watchdog informed public officials that the facilities can be charged with the violation of the Act On The Management And Use Of Livestock Excreta. Public officials initially had concluded that there was no violation, but Watchdog discovered through investigation that the discharge facility was demolished by the owner himself to avoid penalty.

The watchdog will make sure that 99 dogs that have taken over to the Ganghwa County Office receive all the support needed. And we will eliminate the slaughterhouse permanently.
